The information contained on the Website are provided based on the belief, in good faith, of their accuracy and veracity, as well as respecting the journalism professional ethic principles in force. However, while placing the utmost care in maintaining its Website and considering its contents reliable, Biogenera disclaims any and all liability for any direct or indirect damages resulting from errors or inaccuracies of content, or lack of current information, especially where the information is used by the client to make decisions concerning initiatives or activities of an economic or financial nature. Given the free access to the Website and the purely informative purpose of the information contained therein, this does not, in any way, give any type of rights to the users; therefore, Biogenera reserves the right to apply changes and variations as well as to amend of delete parts of the Website, products, services or activities described therein.

Access to and consultation of the Website assume that the system used by the client is fully compatible with the technology used by Biogenera and that connection does not result in any malfunctioning of the computer structures used. In no way may Biogenera be held responsible for any damage to computer systems resulting from the connection to the Website, or from connection links to other websites, even in the presence of computer viruses or other causes attributable to or related to the use of the Internet.

The Website contains links to third-party websites. The existence of such links does not imply that Biogenera sponsors or is affiliated with the owners of the linked sites. Therefore, Biogenera disclaims any liability with regard to the link and the content of the sites linked to the Website and informs users that whoever decides to visit a linked site do so in autonomy, and by assuming the responsibility of adopting the all precautions against viruses or other destructive elements.

Privacy

Biogenera expresses its commitment and attention to the processing of personal data of those using the www.biogenera.com website (hereinafter referred to as the “Site”) by adopting a personal data confidentiality policy that complies with the regulations of the current personal data protection code (hereinafter referred to as the “Privacy Code”) contained in Legislative Decree No. 196 dated 30 June 2003.

This page describes the methods used for processing of personal data of users who consult the Website, through a specific disclosure that is made, pursuant to article 13 of the Privacy Code, to all to all those who interact with web services provided by Biogenera, accessible electronically from the address: www.biogenera.com corresponding to the official home page of the Website.

The information applies solely to the Website and not to other websites eventually consulted by the user through links accessible from the site. The information provided on this page also takes into account Recommendation No. 2/2001 that the European authorities for the protection of personal data, gathered in the Group established by Article 29 of European Directive No. 95/46/EC, adopted on 17 May 2001 to identify minimum requirements for collecting personal data on-line, such as, in particular, the manner, timing and nature of the information that data controllers must provide users with when they connect to webpages, regardless of the purpose of the link.

Information under Article 13 of the Privacy Code concerning the processing of data related to navigation of the Website

Type of data processed and purpose of the processing
Navigation of the Website is free and does not require registration by the user except in cases where the collection of personal data is needed to achieve certain objectives such as, but not limited to: providing paid services, asking for commercial information regarding Biogenera services, enabling forum participation, sending of a resume or sending e-mails to the addresses indicated on the Website.

Therefore, during access to the Website, it is possible to distinguish the data from the single user navigation and data voluntarily provided by the user in relation to certain purposes.

Data deriving from the user’s browsing
During normal operation, computer systems and software procedures acquire some personal data whose transmission is implicit when using Internet communication protocols.
This information is not collected to be associated with identified individuals, but, due to its very nature and through processing and association with data held by third parties, could identify users. Biogenera never commissions or has third parties carry out the processing and association of data.

This category of data includes IP addresses or the domain names of the computers used by users who connect to the Website, Uniform Resource Identifier addresses of resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the reply given by the server (successful, error, etc.) as well as other parameters relative to the operating system and the user’s computing environment.

This data is used by Biogenera exclusively in anonymous form for statistical purposes related to the use of the Website and its proper functioning. The data could be used and stored in case of suspected computer crimes against the Website, for which Biogenera reserves the right to resort to the competent authorities to ascertain any liability.

Data provided voluntarily by the user
Personal data provided voluntarily by users who interact with the Website by giving their personal data to Biogenera for the attainment of certain services (paid services, sales inquiries, forumparticipation, sending of resumes, sending of e-mails, etc.) are used solely to provide the service or provision requested, and are communicated to third parties only when strictly necessary for the performance of the service (shipment of materials provision of assistance, etc.).

Specific summarized information will be reported or displayed in the pages of the Website dedicated to on-demand services in order to draw the attention of the party for which the personal data will be processed.
Apart from the information specified above regarding navigation data, the transfer of personal data is optional, although functional to the provision of certain services; therefore, in these cases, failure to provide data may impair or prevent the provision of service.

Location and methods of data processing
Processing connected to the Website services will take place at the Biogenera headquarters, and are carried out by technical staff specifically employed for the processing of data through manual or automated instruments for the time strictly needed for the purposes for which the data were collected. Data originating from the web service is not communicated or disseminated to third parties without the consent of the individual concerned except in cases where this is strictly functional to rendering a service requested by the interested party (e.g. Postage, maintenance, etc.).

User rights

Pursuant to article 7 of the Privacy Code, the user has the right to: 1) confirmation of the existence or otherwise of his/her personal data, even if not yet recorded, and its communication in intelligible form; 2) indication of: a) the origin of personal data; b) the purpose and method of processing; c) the logic applied in case of processing with the help of electronic instruments; d) the identity of the owner, manager and the representative appointed under article 5, paragraph 2 of the Code; e) the subjects or categories of subjects to whom the personal data may be communicated or who can become aware of it as appointed State representative, managers or agents; 3) a) updating, rectification or, when interested, integration of data; b) the cancellation, transformation into anonymous form or blocking of data processed unlawfully, including data whose retention is not necessary for the purposes in respect of which the data was collected or subsequently processed; c) certification that the operations in letters a) and b) have been brought to knowledge, as also related to their contents, to those to whom the data was communicated or disseminated, except where this requirement proves impossible or involves the use of means manifestly disproportionate to the protected right. 4) The interested party has the right to fully or partially oppose: a) for legitimate reasons to the processing of personal data, pertinent to the collection purpose; b) the processing of its personal data for the sending of advertising, direct sales or for carrying out market research or commercial communication.
